Rebuttable presumption

A fact which shifts the “burden of proof” from one party to the other in a lawsuit. It has been proposed that if a physician sued for malpractice has followed approved clinical practice guidelines, this would create a legal presumption that the physician was not negligent. Such a presumption may be rebutted by the plaintiff offering additional evidence, but it will be harder for the plaintiff to win in such a case.
